A living is all the needs and needs of a person for the person who is
responsible for meeting the basic needs needed. In Islamic law, if the contract has
taken place and legally fulfills the terms and conditions, then consequences arise
which also give rise to rights and obligations as husband and wife in the family. If
a husband neglects his obligations, the wife has the right to sue the husband, in the
sense that demanding a living is not execessive, not to live in luxury but according
to the needs of the husband’s ability. This is the main problem in this research.
This research is field research, in this case the data or information comes from
Bedanten Village, Bungah District, Gresik Regency. And this research is
descriptive-analytic, the source of data is primary data and secondary data. That is
obtained from the Al-Qur’an, hadith, and literature that has to do with the subject
matter.
]The results of this study can be stated that the demands for a living that occur
in Bedanten Village, Bungah District, Gresik Regency demand to provide even
more income, while the husband has provided a living that is in accordance with
the level of living in islam. Whereas in Islamic law the wife has the right to only
sufficient of her husband’s property, so the demands for maintenance should not be
excessive, but live according to the needs and capabilities of the husband. And
Islamic law the wife should feel sufficient if she is given a living and do not burden
the husband especially when the husband is poor.
